Agreement between Book It Please and Guest Regarding Use of Website, and booking arrangements for hotels, rentals, attractions, restaurants and other events.

Use of the website Book It Please.com is restricted to the terms and conditions proposed in this Agreement. The terms “we”, “us”, “our”, and “Book It Please.com” refer to Book It Please. The term “you” and “your” refers to any customer visiting the Website or using the Website to make a booking for any of the services offered through us. This Agreement describes your responsibilities as a user of this website and limits the liability of Book It Please.com.

These terms and conditions by Book It Please.com administer your use of this website; by accessing, browsing and using our website or any of our applications through whatever platform (site or app), you accept these terms and conditions in full. You acknowledge and agree to have read, understood and agreed to the terms and conditions set out below (including the privacy statement).

Registration

To register for the Service (use of the website), a user must complete the registration process available on the Website and obtain their personal authentication credentials.

The User represents and warrants that all personal data and information provided during the registration process is up-to-date, complete, accurate and true. The User undertakes to communicate to Book It Please.com any changes of his/her personal data in a timely manner.

The User authorizes Book It Please.com to verify the accuracy of the personal data, and any other information it provides to Book It Please.com and undertakes to cooperate with Book It Please.com during such verification process.

At the end of the registration process, the User will receive authentication credentials, consisting of a User ID and a secret password for which it shall be the User’s sole responsibility to keep secret, and the User shall be responsible for the activities carried out on the Website through such User ID and password. All operations carried out through the User ID and password of the User shall be attributed to the User of such operation and requests. Therefore, the User is liable for any possible damage caused to or prejudices against Book It Please.com because of the misuse, loss, misappropriation and/or compromising of the confidentiality of the User ID and password. The User acknowledges that Book It Please.com may also produce, as evidence of the operations carried out by the User, proofs obtained from the systems and procedures used by Book It Please.com in order to regulate access to the Website and to provide the Service.

The User must not conduct any mechanical or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to this website without express written consent.

Scope of our Service

Once the registration process is adequately completed, the User will be able to fully access Book It Please.com's Service, which includes:

(i) information on different types of accommodation, venues and workspaces, attractions, restaurants, cultural, sports and other events.

(ii) the use of Book It Please.com's search engine to look for accommodation, venues and workspaces, attractions, restaurants, cultural, sports and other events, and

(iii) to use, by means of a license., Book It Please.com’s software application which allows the User to directly process a booking, without the need of making another connection to any third-party websites.

By making a reservation through Book It Please.com, you enter into a straight (lawfully binding) contractual relationship with the accommodation or service provider at which you book. From the point at which you make your reservation, we act solely as an agent between you and the property or service operator, transmitting the details of your booking to the relevant accommodation or service provider and sending you a confirmation email for and on behalf of the respective third party provider.

The information available on the site is based on the information provided to us by accommodation and service providers. As such, they are given access to our CMS through which they are fully responsible for updating all rates, inventories and other details which are displayed on our website. Although we will make every effort in providing the most accurate information, and cannot guarantee that all information is accurate, complete or correct, nor can we be held responsible for any errors.

Each accommodation or service provider remains responsible at all times for the accuracy, completeness and correctness of the (descriptive) information (including the rates and availability) displayed on our website. Our website does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level, qualification or (star) rating of any accommodation made available.

Use Of The Website

The User can freely visit the Website and use its functionality for personal, not commercial, use only. When doing a search in the Book It Please.com’s search engine or making bookings, the User recognises and states that they are acting in a purely personal capacity.

While searching or processing bookings, the User uses the web application by means of a non-exclusive and temporary license, granted for the time of the operation. This web application allows the User to process, easily and directly, their requests without having to make an additional parallel connection to the website of the provider of the service the User is interested in booking.

The User is not allowed to modify, reuse, copy, distribute, transmit, reproduce, publish, or create derived tasks or jobs, transfer or sell, or in any case, make any commercial use or any use that is not personal in nature of the information, news, content, software and systems, or products obtained or made available to the User through the Website and the use of the Service.

To be able to use the functions of the Website, the User must have an internet connection, which they must procure at their own expense from a reliable provider. Book It Please.com is not liable for any damages to the User's hardware that may be caused, directly or indirectly, by the internet connection.

Rules of Conduct

The User undertakes to use the Website, its functions and the Service for lawful purposes and according to the present T&C. Particularly, the User undertakes neither to send or spread, through the Website and its functions, illicit, defamatory, vulgar, obscene, abusive or disturbing content, nor to use the Website and its functions to perform any acts which could cause damage to the image and reputation of Book It Please.com or any other loss or damage to Book It Please.com.

Moreover, the User undertakes not to send advertising materials, undesirable and/or unsolicited communications which could interfere with the functionality and/or the use of the Website by third parties.

Free of charge

Our service is free of charge. Unlike many other parties, we shall not charge you for any bookings confirmed by you using Book It Please.com, nor shall we add any additional (reservation) fees to the rates available on our website..

Accommodation providers pay a commission (which represents a small percentage of the room price) to Book It Please.com after the guest has checked out from the hotel and paid in full for the accommodation.

Credit card or bank transfer

If applicable and available, there are some hotel partners and service providers which offer the opportunity for bookings to be paid (completely or partially) to the accommodation provider during the reservation process by means of secure online payment. Payment is safely processed from your credit/debit card or bank account to the bank account of the accommodation or service provider through a third-party payment processor.

For certain (non-refundable) rates or special offers, the accommodation providers may require that payment is made upfront by wire transfer (if available) or by credit card, and therefore your credit card may be pre-authorised or charged (sometimes without any option for refund) upon making the reservation. Please check the booking details thoroughly for any such conditions prior to making your reservation.

Cancellation Policy and No Shows

Cancellation policies vary not only for different accommodation and service providers but also depending on the rate that is booked. Please refer to the individual full rate descriptions provided at the booking stage.

Rates marked as “Refundable” - These flexible bookings can be cancelled within the specified cancellation policy, and a full or partial refund shall be processed if the booking is cancelled in writing or via the My Bookings section of your Book It Please account in line with the cancellation Rules and Restrictions of the relevant accommodation or service provider. Late cancellations or no-shows will be charged at full room rate. Promotional, all-inclusive and advance rates are non-refundable and non-transferable in the event of cancellation. We reserve the right to charge for one night’s accommodation rate per room booked if the above cancellation requirements are not met.

Rates marked “Non-Refundable” - Full prepayment for the entire stay at the time of the booking is required. Once confirmed and prepaid, the booking cannot be cancelled and/or amended Prepayment is charged to the credit/debit card provided at the time of the Booking.

Cancellation by Book It Please

On rare occasions, we may have to cancel your booking for reasons beyond our control. We will notify you as soon as we are aware that the reservation cannot be processed and will offer alternative accommodation of the same standard, or higher. If none of the suggested options meet your requirements, we will process a full refund. We will not pay compensation or any reimbursement of incidental expenses or costs you may incur because of any such cancellation or change.

Disclaimer

Neither we nor any of our officers, directors, employees, representatives, subsidiaries, affiliate partners, distributors, agents or others involved in creating, sponsoring, promoting, or otherwise making available the site and its contents shall be liable for

(i) any disciplinary, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim,

(ii) any factual error relating to the (descriptive) information (including rates, availability and ratings) of the accommodation as made available on our website,

(iii) the services rendered, or the products offered by the accommodation provider or other business partners,

(iv) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our website, or (v) any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, wilful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the accommodation or any of our other business partners (including any of their employees, directors, officers, agents, representatives or affiliated companies) whose products or service are (directly or indirectly) made available, offered or promoted on or through the website, including any (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control.

Whether the accommodation you stay at charges you (or has charged you) for your room, or we are facilitating the payment of the room price by using a service provider, you agree and acknowledge that the accommodation provider is at all times responsible for the collection, withholding, remittance and payment of the applicable taxes due on the total amount of the room price to the relevant tax authorities. Book It Please.com is not liable or responsible for the remittance, collection, withholding or payment of the relevant taxes due on the room price to the relevant tax authorities.
